These Terms of Service ("Terms") govern your access to and use of Field Boss Pro (the "Service"), a field-service management platform operated by Fleming USA ("Field Boss Pro," "we," "us," or "our"). By creating an account, accessing, or using the Service you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
The Service is intended for business use by service contractors and their authorized staff. You must be at least 18 years old and have the legal authority to enter into a binding agreement on behalf of yourself or the organization you represent.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at darryl@flemingusa.com if you suspect unauthorized access to your account.

You retain ownership of the data you submit to the Service (work orders, customer records, photos, messages, etc.). You grant us a limited license to host, process, transmit, and display that data solely as necessary to provide the Service to you.
When you use Field Boss Pro to send SMS, voice, or email communications to your customers, you represent that you have the legal right and any required consent to do so. You are solely responsible for the content of those communications.
The Service integrates with third-party providers including but not limited to Twilio, Stripe, Vapi, Resend, American Home Shield, First American Home Warranty, Marcone, Reliable Parts, and Thumbtack. Your use of any third-party integration is subject to that provider's own terms and privacy practices, and we are not responsible for the acts or omissions of those providers.
The Service, including all software, design, text, and branding, is owned by Fleming USA and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use Fleming USA's name, logo, or trademarks without our prior written permission.
We strive to keep the Service available but do not guarantee uninterrupted access. The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Fleming USA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. Our total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim.
You agree to indemnify and hold harmless Fleming USA from any claim, loss, or expense (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.
We may suspend or terminate your access to the Service at any time if you violate these Terms, fail to pay fees when due, or use the Service in a way that we reasonably believe poses risk to us, our other customers, or third parties. You may stop using the Service at any time by canceling your subscription and deleting your account.
We may update these Terms from time to time. If a change is material we will provide reasonable notice (for example, by email or in-app notice). Continued use of the Service after the effective date of any change constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service shall be brought exclusively in the state or federal courts located in Collin County, Texas.
